Austria to Follow Germany in Regulating Online Gambling

The European Court of Justice has ruled that Austria’s casino licensing process and the monopolisation by Casinos Austria broke European Law. After passing a judgement on Germany’s gaming industry earlier in the week, the ECJ have deemed that the concessions granted to Casinos Austria discriminated against foreign operators as well as breaking EU law.

The Austrian laws, which were updated as recently as June of this year, do actually invite companies located in other European countries, but the requirements for gaming companies constitute restricted freedom of establishment. In addition to this, the twelve licenses permitting casinos that were issued to Casinos Austria were not subject to a transparent or possibly fair process.

After having tackled Germany and Austria, the ECJ is thought to be investigating Belgium’s gambling industry and look set to continue examining all around Europe. The effect of this, as already seen in Germany, is that private gambling operators would be allowed to enter each country concerning in a situation that has been described as “legal chaos”.
