A card counter is locked in a battle with Grand Victoria Casino, in Indiana, over the legality of card counting at blackjack tables. Tom Donovan has been battling with the casino since 2006, when he was banned from playing blackjack at the gambling venue. Grand Victoria alleged that, under common-law, they are allowed to ban anyone at any time from entering their venue. However, Donovan’s attorney, Marc Sedwick, has suggested that casinos should adhere to specific state gaming regulations - not legislation which predates the legalisation of gambling in Indiana. As the state does not have any rules regarding barring card counters from venues, if Donovan won his case, Grand Victoria would be forced to allow the blackjack expert to enter the casino.

Donovan’s case is currently being heard in Indiana high court. When the case was first heard in a Marion County court, the judge ruled in Grand Victoria’s favour, but the state appeals court overruled this and settled in Donovan’s favour. Now, Grand Victoria has asked the high court to step in. Speaking about the case, Donovan has made clear the legality of card counting, informing reporters that he’s “not cheating at all”, simply “using” his brain.
