Online Gambling Could be Coming to Germany

Online gambling could be set to re-enter Germany, after having been exiled by The German State Gambling Treaty, following a ruling made by the European Court of Justice. The reason for the potential re-opening of the market is that the European Union’s highest court has ruled that the current German state monopoly on gambling is illegal. As a result of this, it will have to be dismantled which in turn creates the opportunity for the country’s online gambling market to become regulated.

Following several German online gambling companies taking cases to the ECJ, the decision was made that “the German rules do not limit games of chance in a consistent and systematic manner”. The current laws in Germany prohibit organisation or implementation of all forms of public games of chance on the internet. The ECJ stated that the main reason for its ruling is that the “preventive objective” of the German monopoly of online gambling (preventing gambling addiction) “ceases to be justifiable”.
